9. I have heard that Kaiser members do not have the right to bring suit for medical malpractice, is this true?

Yes. Since the early 1970's, all Kaiser members have been required to resolve claims for medical malpractice through the utilization of the Kaiser Permanente Arbitration System. Although Kaiser members have attempted to challenge the system on various grounds, it has been repeatedly determined to be valid and constitutional by the California courts. The Kaiser Arbitration System has recently undergone significant changes. The differences between the Kaiser Arbitration System and Superior Court suits are too numerous to list here.
